Virage — Terms of Service (English)

These terms govern your use of the Virage mobile application, published by Guillaume Bernos. By installing or using the app you accept them; if you do not, please do not use it.
1. What Virage is
Virage is an interactive audio fiction app offering recorded stories, in French, in which the listener chooses at certain moments which way the story goes. It runs offline and requires no account, sign-up or network connection.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for personal, non-commercial purposes.
You may not extract, copy, redistribute, publicly perform, sell or otherwise make available the recordings, texts, voices, music or artwork; use any of the content to train a machine learning model; decompile, disassemble or reverse engineer the app except where the law mandates it; or remove any proprietary notices.
3. Intellectual property
The app, its code, design, stories, texts and recordings are protected by copyright and remain our property or that of our licensors. These terms transfer no ownership to you. "Virage" and its logo are our distinctive signs.
4. Fiction
All stories in the app are works of fiction. Characters, places, events and organisations are imaginary or used fictitiously; any resemblance to real persons, living or dead, or to actual events, is coincidental. Some stories are detective fiction and refer to crimes, including homicide, without gratuitous or graphic detail. They are written for teenage and adult listeners.
5. Safety — listening while driving
The app is made to be heard on the move. You remain solely responsible for your safety and for obeying traffic law. Do not handle your phone while driving: if a choice appears while you are at the wheel, let the timer run out — the story carries on by itself — or stop somewhere safe. We accept no liability for use of the app contrary to applicable regulations or to basic care.
6. Purchases and subscription
The app is free, and the volume Le Manoir Noir is free with it: it installs with the app and plays offline, with no purchase of any kind.
The other volumes are paid, and offered two ways, through Apple's App Store:
- individually — a one-off, non-renewing purchase that gives you that volume for good. It restores across your devices and is eligible for Family Sharing. Related volumes are also offered together as a set;
- by subscription — Virage — annual subscription, renewing year to year, giving access to the whole collection, future volumes included, for as long as it is active.
The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged within the 24 hours before renewal, at the rate then in force. You can view, manage and cancel your subscription at any time in your App Store account settings; cancellation takes effect at the end of the period already paid for, and there is no pro-rata refund of the current period.
A volume you buy outright stays yours; a volume the subscription opens does not. When a subscription ends, volumes it alone gave access to stop being available and their audio is removed from the device. Your progress is never erased: your saves, clues and stamps survive, and you find them intact if you acquire the volume later.
Prices are those shown by the App Store in your country at the time of purchase, and are presented to you before you confirm. We may change our prices; a price change to a running subscription is notified by Apple and takes effect only with your agreement, on the terms the App Store provides.
Purchases are made by Apple, not by us. They are subject to the App Store's terms, including its refund rules: a refund is requested from Apple. Apple may revoke a purchase — a refund, a chargeback, a change in Family Sharing — and the volume concerned then stops being accessible, on the same terms as above.
7. No warranty
The app is provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose or uninterrupted, error-free operation. Nothing here removes the statutory rights you have as a consumer under French law.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect damages, nor for loss of progress caused by uninstalling the app, changing device, or clearing app data. Progress is stored locally; it is not backed up on our servers, because we have none.
9. Privacy
The app collects no personal data. See the privacy policy.
10. Changes
We may change the app, add or remove volumes, and update these terms. The date at the top shows the current version; continued use after a change constitutes acceptance.
11. Governing law
These terms are governed by French law, with the French courts having jurisdiction failing an amicable resolution. As a consumer you keep the right to bring proceedings where you live.
